By accessing or using the website amazonicart.com ("the Site"), operated by Amazonic Art ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Site.

2. About Amazonic Art

Amazonic Art is an online art gallery based in Costa Rica that connects indigenous Amazonian artists with collectors worldwide. We sell original paintings, canvas prints, acrylic prints, and paper prints featuring authentic amazonic and visionary art.

3. Products and Descriptions

We make every effort to display our artwork as accurately as possible. However, due to variations in monitors, screens, and display settings, actual colors may differ slightly from what you see on screen. All dimensions, materials, and descriptions are provided in good faith.

Product availability is subject to change without notice. We reserve the right to discontinue any product at any time.

4. Pricing and Payment

All prices on the Site are listed in US Dollars (USD). Prices are subject to change without prior notice, but changes will not affect orders that have already been confirmed.

We accept payment via:

• Credit card — processed securely through Tilopay
• Bank transfer — no VAT charged on bank transfers (saving 13%)

Payment must be received in full before artwork is shipped. For bank transfers, we will provide payment instructions upon order confirmation.

5. Orders and Confirmation

Placing an order on the Site constitutes an offer to purchase. We reserve the right to accept or decline any order. Once your order is confirmed and payment is received, we will send you a confirmation email with order details and estimated shipping timeline.

6. Shipping

• International shipping: flat rate of $150 USD worldwide
• Costa Rica and Peru: free shipping
• All artwork is professionally packaged to ensure safe delivery
• Tracking information is provided for all shipments
• Delivery times vary by destination; estimated timelines are provided at checkout

Amazonic Art is not responsible for customs duties, import taxes, or additional fees imposed by the destination country. These charges are the responsibility of the buyer.

7. Returns and Refunds

Due to the unique, handmade nature of our artwork:

• Returns are accepted within 14 days of delivery for items received damaged or significantly different from the description
• Custom commissions are non-refundable once production has begun
• To initiate a return, contact us via WhatsApp at +506 8308-7148 or email with photos of the issue
• Return shipping costs are the responsibility of the buyer unless the item was damaged in transit or incorrectly described

8. Certificate of Authenticity

All original paintings come with a certificate of authenticity signed by the artist, verifying the work is genuine and original. Prints are clearly labeled as reproductions.

9. Intellectual Property

All content on the Site — including images, text, logos, designs, and artwork photographs — is the property of Amazonic Art or its artists and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

Purchasing artwork grants you ownership of the physical piece but does not transfer copyright or reproduction rights, which remain with the artist.

10. User Accounts

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate and complete information and to notify us immediately of any unauthorized use.

11. Fair Trade Commitment

Amazonic Art is committed to fair trade practices. All artists receive transparent, fair compensation through direct partnerships. By purchasing from us, you support sustainable income for indigenous communities in the Amazon.

12. Limitation of Liability

To the fullest extent permitted by law, Amazonic Art shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of artwork, including but not limited to loss of profits, data, or goodwill.

Our total liability for any claim arising from these terms or your use of the Site shall not exceed the amount you paid for the specific artwork in question.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Costa Rica. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Costa Rica.

14. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated revision date. Continued use of the Site after changes constitutes acceptance of the updated terms.
